Terms of Service

3.1 Age and Capacity

You must be at least 18 years of age and have the legal capacity to enter into contracts under Canadian law to use our Services. By using the Platform, you represent and warrant that you meet these requirements.

3.2 Account Registration

To access certain features, you must create an account. You agree to:

• •Provide accurate, current, and complete information during registration
• •Maintain and promptly update your account information
• •Maintain the security of your account credentials
• •Accept responsibility for all activities under your account
• •Immediately notify us of any unauthorized access or security breach

3.3 Contractor Verification

Contractors must provide valid licenses, insurance certificates, and other credentials as required by Alberta law and municipal regulations. Rifyn reserves the right to verify all submitted documentation and may suspend or terminate accounts that fail verification.

4.1 Marketplace Facilitation

Rifyn operates as a marketplace platform that connects homeowners with contractors. We facilitate connections but do not:

• ✗Perform construction or renovation services
• ✗Employ contractors or control their work
• ✗Guarantee the quality, safety, or legality of services provided
• ✗Act as an agent or representative of any user

4.2 Independent Contractor Relationship

All contractors on the Platform are independent contractors, not employees, agents, or partners of Rifyn. Contracts for services are formed directly between homeowners and contractors. Rifyn is not a party to these contracts and bears no responsibility for their performance or outcome.

4.3 AI-Powered Matching

Our Platform uses artificial intelligence to match homeowners with suitable contractors. While we strive for accuracy, we do not guarantee that AI recommendations will meet your specific needs or expectations. Users should conduct their own due diligence before entering into any agreement.

6.1 Platform Fees

Rifyn charges service fees for connecting users and facilitating transactions. All fees are displayed clearly before you commit to a transaction. Fees are subject to change with 30 days' notice.

6.2 Payment Processing

All payments are processed through secure third-party payment processors. You agree to provide accurate payment information and authorize charges according to the payment terms. All prices are in Canadian Dollars (CAD) and include applicable taxes.

6.3 Refund Policy

Platform fees are generally non-refundable except:

• •If charged in error
• •As required by applicable consumer protection laws
• •At Rifyn's sole discretion in exceptional circumstances

Refunds for services between homeowners and contractors are governed by the terms of their direct agreement and are not the responsibility of Rifyn.

7.1 Rifyn's Property

The Platform, including all content, features, functionality, software, designs, text, graphics, logos, and trademarks, is owned by Rifyn or its licensors and is protected by Canadian and international intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without express written permission.

7.2 User Content

You retain ownership of content you submit to the Platform (photos, project descriptions, reviews, etc.). By posting content, you grant Rifyn a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for the purpose of operating and promoting the Platform.

You represent and warrant that you own or have the necessary rights to all content you submit and that your content does not violate any third-party rights or applicable laws.

8.1 No Warranty

Rifyn does not warrant that:

• •The Platform will be uninterrupted, secure, or error-free
• •Contractors are qualified, licensed, or will perform work competently
• •Projects will be completed on time, within budget, or to your satisfaction
• •AI-powered recommendations will be accurate or suitable for your needs

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RIFYN SHALL NOT BE LIABLE FOR:

• •Indirect, incidental, special, consequential, or punitive damages
• •Loss of profits, revenue, data, or business opportunities
• •Property damage, personal injury, or death arising from contractor services
• •Disputes, delays, or failures in performance between users

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount of fees paid by you to Rifyn in the 12 months preceding the claim, or CAD $100, whichever is greater.

8.3 User Responsibility

You acknowledge that you are solely responsible for verifying contractor credentials, obtaining necessary permits, ensuring compliance with building codes, and conducting adequate due diligence before entering into any service agreement.

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

10.2 Jurisdiction

You irrevocably submit to the exclusive jurisdiction of the courts of Alberta, Canada, for the resolution of any disputes arising from or relating to these Terms or your use of the Platform.

10.3 Informal Resolution

Before initiating formal legal proceedings, you agree to first contact us at legal@rifyn.com to attempt to resolve the dispute informally. We will make good-faith efforts to resolve disputes amicably within 30 days.
